UPCOZ Pty Ltd ACN 621 899 634 ( "UPCOZ", "we", "us" or "our") holds a sports bookmaker's licence by the Greyhound Welfare and integrity Commission  ("GWIC") to provide a social gambling environment ( UPCOZ Services ) via the UPC Showdown Application ( Application or App ). We also operate the website at the URL https://www.upcoz.com where customers can find out more about the UPCOZ’s Services ( Website ).

UPCOZ is dedicated to ensuring that we comply with our obligations under the Privacy Act 1988 (Cth) (the Act ) and the Australian Privacy Principles (the APPs ). This Privacy Policy explains how we manage the personal information that is collected, used, disclosed and stored about you.

This Privacy Policy should be read in conjunction with UPCOZ's Terms and Conditions, which are available on the website https://help.upc.bet.  By using the UPCOZ Services or by otherwise providing your personal information to us, you confirm your acceptance of the terms of this Privacy Policy and your consent to the handling of your personal information as set out in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use the Website or otherwise provide us with your personal information.


What is personal information?

Information we collect about you UPCOZ collects personal information and other non-personal information in order to open and maintain a player's UPCOZ Account. The information which we may collect and process will include a player's:

  • Full Name
  • Residential Address
  • Telephone Number
  • Email Address
  • Date of Birth
  • Bank Account Details

We may collect your personal information when you:

  • visit the Website, Application and other platforms that we own and manage;
  • register for a player account on our Application or when you manage/change your account information; contact us by phone or email; sign-up to participate in competitions or other promotional activities on our Application.


In certain circumstances, where UPCOZ is unable to identify an Individual Player, further personal information may be collected for the sole purpose of ID verification.

UPCOZ may contact you via the data you have supplied in order to open your account. Only in the circumstance where you have granted UPCOZ the right, will UPCOZ contact you with special offers and promotions. You may elect to grant or rescind this right at anytime by contacting [email protected].

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing.  We may also collect, use and disclose your Personal Information for secondary purposes related to the primary purpose including in circumstances where you may reasonably expect such collection, use or disclosure and/or for purposes including (but not limited to) trading, risk management, integrity, compliance, minimum bet laws and/or other related purposes including purposes reasonably required by applicable Principal Racing Authorities (Secondary Purposes). Further, We may collect information from other service providers, regulators, racing bodies, sporting bodes and other third parties associated with our products and services.  Collection of such information may include information aggregated by a third party.   


How do we use your personal information?

UPCOZ will only use your personal information for the purpose for which it was collected or to comply with any legal process under Australian or New Zealand Law.

UPCOZ uses your personal information for the following:

  • Opening and maintaining your account, including responding to any questions, comments requests or complaints which you submit to us;
  • Verifying your identification;
  • Complying with State, Federal and International Laws governing gambling and Anti-Money Laundering, or for any other purpose to allow us to comply with our obligations under law;
  • Contacting you in cases of system failure;
  • Contacting you with promotional or special offers; and
  • Notifying you of changes to our systems or Terms and Conditions.

If UPCOZ is required to disclose any of your personal information under a legal process and if it is permitted under that process, UPCOZ will inform you of the circumstances.


Who will we disclose your information to?

From time to time, UPCOZ may disclose your personal information to third parties for the purposes of conducting our business. These third parties may include (but are not limited to):

  • Our associated companies/company group;

  • Employees, third party service and content providers, dealers and agents, affiliates and suppliers who assist us in managing our business or operating our Application and Website;
  • Our professional advisors including lawyers, accountants, tax advisors and auditors;
  • Law enforcement bodies to assist in their functions, courts of law, sports and racing controlling bodies, or as otherwise required or authorised by law.
  • Regulatory or government bodies for the purposes of resolving customer complaints or investigations; and
  • Third party partners to promote their services to you.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. You acknowledge We can provide your Personal Information to BetMakers (the provider of our platform technology and/or managed trading services) - who can also use and disclose your Personal Information these purposes (including Secondary Purposes). Further, We may collect information from Betmakers, other service providers, regulators, racing bodies, sporting bodes and other third parties associated with our products and services. Collection of such information may include information aggregated by a third party.


Marketing and Promotional Materials – opt out

UPCOZ may use your personal information for the purposes of marketing our services/products or to inform you of new products, promotions or events that we believe you may be interested in.

If you would like to stop receiving any of these marketing communications, you can opt out by writing to us at [email protected] and informing us that you no longer wish to receive these materials. If at any time you would like to stop receiving future emails, you can click the "unsubscribe" at the bottom of each direct marketing email we send.

If you wish to cease receiving marketing-related emails from our third party partners, please contact these third parties directly or utilise any opt-out mechanisms set out in their respective privacy policies or marketing-related emails.

 

How do we secure and protect your personal information

We take such steps as are reasonable in the circumstances to maintain the integrity and store securely your personal information to protect it from interference, misuse and loss and from unauthorised use, access, modification or disclosure.

UPCOZ stores your personal information securely and in accordance with industry best practice. At no time do we store any of your bank details. These are stored securely by our third-party Financial Gateway Service Provider.

UPCOZ stores your personal information in Australia and is encrypted at all times.

Accuracy of your personal information

We take such steps as are reasonable in the circumstances to ensure that the personal information that we collect is up-to-date and complete.

However, it is your responsibility to ensure all of the personal information which you provide is accurate and up to date.

You are entitled to access and correct the personal information we hold about you and which you have provided. If you would like to access, update or correct any of the personal information we hold about you, you may do so by contacting [email protected].

Complaints

If you think that at any time UPCOZ has misused your personal information, contact [email protected] with the full particulars of your complaint.

We will then investigate your complaint and endeavour to provide you with our response within a reasonable time. If, after receiving our response you still consider that your privacy complaint remains unresolved, you may then, for example, refer your concern to the Office of the Australian Information Commissioner at www.oaic.gov.au.

Changes to our Privacy Policy

UPCOZ reserves the right to amend this policy at any time. UPCOZ will notify you of any changes to this Privacy Policy within a reasonable time.
